Do I think that every person around the Capitol on 1/6 participated in an insurrection? No, there definitely seems to have been many people who were traditionally protesting. However, the people who stormed the Capitol, injured and killed officers, and utilized such objects are the insurrectionists, imo.

The Capitol Police said it accepted the medical examiner's findings "but this does not change the fact Officer Brian Sicknick died in the line of duty, courageously defending Congress and the Capitol".[36][28]

IMO they will avoid answering the question. The current court isn't interested in setting good law. 5 of the justices are not interested in making life difficult for conservatives even if it's blatantly obvious they are wrong. (Roberts, Thomas, Alito, Barrett, Kavanaugh)
