Today the DA has ended the case and dropped the murder charges he was facing without ever going to trial
It was all on video, Trump guy got in journalists face, Pinkerton got in Trump guy's face, Trump guy pushed Pinkerton, Trump guy pulled pepper spray, Pinkterton drew a handgun, they shot each other at same time, guy with handgun wins.

There is no duty to retreat under state law, but the action taken in self-defense must be generally proportionate to the attack, experts have said.
So whether it was the push or the pepper spray, it won't be a question for a jury of whether it was proportionate, reasonable, immediate risk, etc.
