A New Level of Absurdity

The length California politicians will go to disenfranchise voters has reached a point of all-time absurdity. Before turning to the bill, AB 1495, a bit of context.

In January, Gavin Newsom installed his crony Alex Padilla to replace Kamala Harris in the U.S. Senate. At the time, I wrote a legal memo explaining that this was unconstitutional and Newsom had to let voters pick the new Senator.

Newsom ignored it, but a month later I obtained a formal 10-page opinion from the Legislative Counsel's Office reaching the same conclusion: the Constitution required Newsom to set an election for a Senator to complete Kamala’s term.

I made it clear to Newsom I was prepared to file a lawsuit, and this seemed to get his attention; after all, we'd already beaten him in court once. The Speaker of the Assembly asked me for a copy of the Legislative Counsel opinion.

We now know what happened next. A scheme was concocted to bail out Newsom and Padilla with AB 1495. The bill, which will be rammed through next week, acknowledges I was right: It sets an election for a Senator to fill the remainder of Kamala’s term.

But there's a catch. The special election won't take place right away. Instead, this vote for who will be our Senator through January 2023 is scheduled for November 2022. You read that correctly: we’ll be electing someone to serve for a month.

Here’s the truly crazy part: Padilla will at the same time be running for reelection. So on your November 2022 ballot you’ll see what looks like a printing error: a race for the same Senate seat will appear twice. One vote will be for the last month of Kamala’s term, the other for a new term.

Padilla will ask you to vote for him twice, to try to make up for him assuming office without any vote at all. The point, of course, is to let Newsom's crony serve as long as possible before facing voters.

To make matters worse, Newsom is now trying to push Dianne Feinstein out the door, making way for our other Senate seat to fall prey to the same corrupt shenanigans.

Newsom's Potemkin Village

Yesterday, Gavin Newsom blasted out a bewildering claim. He tweeted that California created “nearly 40%” of all new jobs “in the NATION” last month.

It was fake news. The true “unadjusted” figure is 14 percent. The jobs report actually paints a dismal picture for California: Our unemployment rate is worse than every state but Hawaii and isn’t improving.

Yet that didn’t stop the Governor from gloating we are “leading the nation’s economic recovery.” The Legislative Analyst also just caught him overstating the surplus by a paltry $38 billion. Welcome to Gavin Newsom’s Potemkin Village.

It’s like in Animal Farm, when the pig-ruler Napoleon tries to make his starving farm look prosperous by filling up the food bins with sand, adding grain only at the very top.

That's Newsom’s plan for the Recall: to make it go away before anyone notices it's just sand in the bins. Incredibly, after months of delay tactics, Newsom has done a complete about-face and now wants the vote sooner. His allies are openly trying to manipulate the election date to boost his odds of survival.

But whenever the vote is, Californians aren't about to be fooled by Orwellian doublespeak. In the fine print of his January Budget, Newsom says it will take five years for our economy to recover with him as Governor. I say that with a new Governor, we can be back stronger than ever in five months.

And we just got some hope from Pennsylvania, where voters passed a constitutional amendment to limit their governor’s emergency powers. Now is the time for a revival of liberty and self-government.

The Anti-Civics

Yesterday the Assembly passed a bill to make Critical Race Theory (dubbed “ethnic studies”) a high school graduation requirement. The vote was 58-9, and I gave the only speech in opposition. You can watch it here and read excerpts below.

When the first version of this curriculum was released, it was universally condemned. The Legislative Jewish Caucus said it “echoes the propaganda of the Nazi regime.”

You’d think our response would be to scrap the whole thing. Instead, we said: let’s make a few tweaks, tone down the Nazi propaganda, and then impose it on every high school student in California.

The inadequacy of this response is clear from the continuing opposition of Jewish-American groups, even on the curriculum’s fourth draft. One group called it “tantamount to putting an even larger target on the back of every Jewish student."

And anti-Semitism is just one manifestation of what is so fundamentally wrong with this curriculum. Its undisguised purpose is to impose on students a particular worldview, rather than giving them the tools to construct one for themselves.

What I find particularly offensive is the notion that this curriculum is about “equity.” Since being elected, every attempt I’ve made to fight for true educational equity has been snuffed out by the dominant Special Interest at this Capitol, whose business model is to keep kids trapped in failing schools.

That’s why we rank 49 out of 50 in educating poor students, and it's why we’re dead last in reopening our classrooms. This bill is a smokescreen for corrupt education policies that have produced the greatest inequity in the country.

But there's a larger reason this curriculum has been able to gain traction. We’ve simply lost touch with the purpose of education. That purpose used to be preparing students for citizenship; civics wasn't just a brief add-on to one subject but was a unifying thread across all subjects.

As that unifying thread has unraveled, Critical Race Theory has filled the void as the anti-civics. A failure to teach students how to build their communities up has created an opening for those who would have them tear their communities down.

Today I call on our Legislature not only to reject this misguided curriculum, but to renew the true meaning of civic education – one based on a deep appreciation for American institutions and values – so that nothing like it ever rears its head again.

The Shifting Recall Date

For a year we’ve been exposing Newsom’s scheme to install his crony in the U.S. Senate. Finally, the media is taking notice. An SF Chronicle Editorial is headlined: “How California Democrats are conspiring to prevent you from electing your senator.”

But there’s an even more corrupt conspiracy afoot. Newsom’s allies are openly trying to manipulate the Recall's timing to boost his odds of survival.

In truth, we should have an election date already. But in 2017 the Legislature passed a bill to change the rules and drag out the process. The goal was to save a Senator who was then being recalled.

Now, suddenly Newsom’s allies see the delays created by that law as unhelpful for his own Recall. They want it to happen after the June 15 "opening" date but before anything else goes wrong. So they’re simply pretending the 2017 law doesn’t exist.

In sum: they passed a new law to help win one election, and they’re defying that law to help win another. As a result, it now appears we'll probably be voting in September. Whenever it is, we’ll be ready.

Meanwhile, the biggest Special Interests have already poured millions into Newsom's anti-Recall fund. My policy remains to accept nothing from any of them. This is a fight to restore government by the people.

Newsom Spins His Wheels

Yesterday Gavin Newsom spun a giant wheel of fortune in a scene that brought cartoon parodies of his vaccine lottery to life. Then in an instant, he went from Pat Sajak to Julius Caesar.

“We’re still in a state of emergency,” Newsom declared. Chillingly, he added that “the emergency remains in effect after June 15” because COVID “has not vanished.” Since cases may never equal zero, this can only mean one thing: an unending dictatorship in the Roman mold.

Newsom’s press office then lied about what he said, prompting sharp rebukes from the Sacramento Bee, LA Times, NPR, Politico, and other journalists who aren’t quite ready to succumb to a 1984-style Ministry of Truth.

I’m going to try again to pass ACR 196, my Resolution to terminate Newsom’s emergency powers. But frankly, his refusal to end the emergency hardly matters: either way he’ll keep abusing his power until he’s removed from office.

As one example, consider the latest on masks. California and Hawaii now stand alone as the only states defying the CDC. Even worse, in a fit of sheer lunacy Newsom's Administration is requiring masks in the workplace perhaps through next year.

Then there’s our kids, who are being forced to wear them even at recess. Every study has found such cruelty to be senseless. In fact, two new studies – one from the CDC, the other funded by Mark Zuckerberg – show no benefit to masks in school at all.

But I do have some good news about schools. We’ve defeated the year’s most corrupt bill, AB 1316, which could have shut down hundreds of charters. Thank you to everyone who fought back to protect what remains of school choice in California.

My Recall Plans

I want to thank everyone who has encouraged me to run in the Recall election. I can’t tell you how humbled and appreciative I am.

I got involved with the Recall in a supporting role: to help support the countless Californians who worked tirelessly, heroically, to build the greatest citizens movement in our history. I didn’t do so with any intention of being a candidate.

As I’ve traveled the state, I’ve had the chance to meet many of you in person. I’ve listened to your input, and have learned so much. I've thought about what it will take to get our movement across the finish line. And I’m ready to play whatever role gives us the greatest chance to make that happen.

To that end, Orrin Heatlie, the Lead Proponent of the Recall, has offered to organize a committee of Recall leaders to explore that question: whether my candidacy would best serve the goals of removing Newsom and bringing the fundamental change California needs.

At this point, much about the race remains unsettled. That includes the election date, which is looking like September but could be November. The field is also still taking shape. For instance, former acting Director of National Intelligence Ric Grenell is still considering a bid, and he’d be an immediate frontrunner.

So before taking any formal steps, I’m going to trust in the citizens who built this movement. Orrin’s group will account for all dynamics in advising on the best path forward. And I’d love to hear from you directly - just reply to this email!

Running for Governor is never something undertaken lightly, and that’s especially true at this moment. Any candidate must approach the task with the greatest measure of humility and the highest sense of responsibility.

But also, with a sense of possibility: an earnest excitement for what we can achieve together, as we endeavor not just to fire America’s worst governor but to save America’s greatest state.

We’ve already made history. Now comes the fight for California’s future.

Same thing will happen in Cali as happened in Wisconsin. Recall, and he retains office.

My Letter to Newsom

Gavin Newsom’s refusal to end the State of Emergency is too much for even the New York Times. Today's paper has a favorable story about my letter demanding an explanation from him.

The letter, which you can read here, is joined by James Gallagher and Melissa Melendez. We inform Newsom that ending the emergency is not optional:

“Section 8629 of the Emergency Services Act provides that the Governor shall proclaim the termination of a state of emergency at the earliest possible date that conditions warrant." We continue with several queries:

Please identify the “conditions of disaster or extreme peril” that are the predicate for the State of Emergency.

You said the emergency will remain because COVID has not "vanished.” Does this mean you intend to keep it in effect until the case rate is zero?

Identify the metrics you are using to determine that COVID cases are of a “magnitude” that is “beyond the control” of cities and counties.

Meanwhile, Newsom is raking in huge checks from Hollywood, which he exempted from his lockdowns. This penchant for turning emergency powers into cash might explain why he refuses to give them up.

Yesterday was also the deadline to withdraw your Recall signature. A pro-Newsom campaign was set up to get people to recant, and to be fair, it did have some success in Orange County: 1 signature withdrawn out of 215,000 submitted.

Newsom has tried every trick in the book to stop the Recall. But our movement has only grown. Now the people of California can reshuffle the whole stacked deck of our political system.

Newsom Is Cheating

We've just learned Gavin Newsom and the Legislature will ram through a new law, AB 152, to give him total control over the date of the Recall vote. That this is unsurprising doesn't make it any less chilling.

Newsom and his enablers are changing the rules for his own Recall in the middle of the game. They cheat in plain sight then wonder why people lack trust in our elections.

So far, they’ve delayed the vote using a corrupt law from 2017. For instance, they added six weeks to bully people to withdraw their signatures. (The number who chose to do so: 42. That’s less than the number who will win the Newsom Vaccine Lottery.)

Newsom thought his best chance was to put the vote off until the state “opens.” Now he's decided waiting too long presents other risks. So he's changing the law to set the election exactly when he wants.

Newsom is also ignoring media inquiries about our letter asking him to justify the State of Emergency. We're told everything is going back to normal except for the amount of power held by the Governor.

If the election is set for mid-September, we have 100 days to save California. Get ready for the campaign of a lifetime.

Newsom's Big Raise

California politicians are getting a hefty raise. I couldn’t think of anyone less deserving. I’m declining mine and calling on Gavin Newsom to do the same.

But it appears Newsom, already the nation’s highest paid governor, will gladly take the extra $8,809 awarded by his own appointees. Last year, Newsom nobly promised to take a pay cut – then a Public Records Act request revealed he didn’t actually do it.

Worst yet, a Sac Bee investigation has revealed another major boost to Newsom’s personal income: Special Interests like PG&E are paying his wife a large salary through a nonprofit. Then they send their lobbyists to Newsom’s office to write policy.

As for Legislators, the raise comes despite taking most of last year off. On top of their salaries, Legislators get a $40,000 tax-free per diem (which I decline every year). Many also enjoy lavish junkets, including one last year in Hawaii in the thick of the lockdowns.

The Recall is about upending this culture of corruption. More than any one policy, it's about a new paradigm for our public life based on integrity and service. That’s how we’ll fix all the failed policies.

In other news, yesterday James Gallagher and I filed our petition with the California Supreme Court in our case against Newsom. And separately, today James and I published an op-ed about Facebook and Twitter’s censorship of COVID-19’s true origins.

Finally, today is apparently “Reopening Day.” In truth, it will take another few months and a vote of the people before we have a new birth of freedom.

Help me restore integrity at our Capitol
