As far as the no intent argument goes, Comey basically made the distinction between "extremely careless" and "gross negligence."
I'm not a lawyer, so I can't necessarily do a good job of adequately explaining that legal difference, but I do know it is a very fine line. What makes matters worse is that we now have evidence of the DoJ being heavily involved and meddling with the process.
Regardless, the same people who praised Comey for being "non-partisan" and doing his job are now trying to turn him into a villian.
