They had the case of a politician denying a personal scandal to reporters, which showed that briefing reporters is within a politicians normal duties. In this case, the statement was an official press release from the white house press office to the press pool. The law couldnt be clearer
but this judge argued "the other cases were wrongly decided". And that one judges opinion should override the appeals courts and supreme court and be able to unilaterly enact new policy
so yeah this will get completely fucking shredded on appeal, but what a display of judicial intemperment. With a ruling like that which completely ignores stare decisis and the text of the law and all similar caselaw, how can anyone having their case heard in that judges court ever expect a fair trial?
