I think the defense should just sit back, the prosecution has been doing their work for them.
They should continue to sit back a bit.

im sure the judge wants to move on from what is a pretty silly aspect of the case which neither helps nor hurts either side much at all.

Its important to establish these facts anyway because then it doesn't allow any sort of nonsense regarding 'they didnt even prove he did it'
