It's called injustice. Even though it may exist, it does not set a precedent and two wrongs don't make a left.

Your rights can be taken away, since jail exists.

So your rights aren't "inalienable". They are quite alienable.

Jail does not exclude you rights. You have the inalienable right to justice. Justice by definition includes the law. Laws include the possibility of punishment.

However, unjust laws that go against your rights are unconstitutional and invalid.

This is dealing with natural law as well.

It's a checks and balance thing, like how most of our gov is designed. However, there is a line that we must never alow to be crossed. In that crossing the whole thing falls apart.
Btw, that line is there to protect us all. It is literally what we have fought and died for. At least it was when i took the oath.
