You can't just unilaterally declare there was no suspicion of a felony when that question is at the heart of this case and theres not enough evidence one way or the other. Have you read all the witness statements and watched the surveillance tape they cited? Have you reviewed the layout of the homes under construction and compared it to their accounts?

As I said, there are two legal questions there: 1) Did they have reasonable, provable suspicion of a crime in their immediate knowledge and 2) Even if they didn't, did any missing element make them assume such serious criminal liability to preclude self defense.

We know where you stand on these cases ArticShadow. It is weird that there has never been a case where the black guy didn't deserve it with you lol. So I'll just join you in saying: he deserved it, and we all get what we deserve.

There is a reason that prosecutors keep recusing themselves; they can't prosecute a good ole boy.

Chasing people around with shotguns is insane. I would say they would get somebody killed but they did and the person's life just doesn't matter. So no harm no foul in Georgia. Not even an arrest lol.

I could tell you before any thread on a controversial issue that there would be posts from me analyzing the dynamics of the system and trying to boil it down to the critical questions, and there would be posts from you thumping a little red book with a bleeding heart and not even care what the topic is about.

So you don't think that there's enough evidence to arrest these individuals of suspicion of manslaughter?

Basically the way it is nothing bad even happened to the state of georgia.

Do you agree something bad happened at least?

Actually it's far stupider to get in the car. Your chance of surviving is far higher if you fight compared to if you allow the kidnappers to displace you.

That's one thing that was drilled into my head when I did martial arts in high school. We had the police come in and teach us practical self defense and that's one thing they said over and over again.

Silly me. I'll stick with 7 years in the military and 63 years of life in 49 out of 50 states.

The police told his mom that he was killed by a homeowner during a burglary.

Something insane clearly happened. This story went from mundane and likely to end unremarkably to a life and death struggle the moment an unarmed guy charged an armed man and kept thumping him in the head even as chunks of his body were blasted away. Perhaps the mundane story was already criminal, maybe a misdemeanor, maybe a felony up to that point, from either side, and what could have been ended far less seriously even if criminal suddenly became an impromptu deathmatch, and now those details matter in assigning liability. The initial description by the police sound like they were just trying to explain the details they knew about the case, the suspected burglary and pursuit.

There might have been enough evidence to arrest them at the scene until evidence was taken, unless the police were given the video by the person filming at the scene in which case it might provide enough evidence to satisfy not arresting them. Their initial response was only going to be able to judge the immediate claim of self-defense and not whether the pursuit was legitimate, and if they had the video of Arbery charging them that would be enough.

I'm just waiting for someone to stick a shotgun in your face and see how submissive you are to them.

Whenever ive had guns pointed at me I've had visceral reactions. It made me very angry and threatened everytime and ive attacked the person in some way every time.

This guy is having a very human fight or flight reaction in the face of death and he probably would have died either way. He was gunned down because he didnt wanna get shot in the back. I honestly don't know why black people live in the South. I would just start walking North... Not jogging apparently.

Instead of having a fight or flight reaction you would get on your knees and be nice to your executioners? I don't believe it. Not after you have been running already and your pulse is going and adrenaline is pumping because youre a black guy and literal armed racist are chasing you in georgia. You run or fight, because if you don't you die regardless and if you do you die when people are using force multipliers on you...those instincts that dealt with natural predators are still there.

If he was armed he could have fought back, but he would be promptly arrested and incarcerated and if he got one of these psychos they would have a rural highway named for them.
