Well the real point is that she can apply her perfume wherever she wants. She might be a real bitch if she does it on a bus or train, but the point is that we don't go around making it illegal.

Whoever owns the land/location has the right to set the rules of conduct. Restaurants have the right to refuse service, for any reason; as do many other shops. I disagree with the bar smoking ban, as that should be left up to the owners discretion (besides, its a bar, a place you go to drink and meet ladies, you probably aren't worried about your health).

Now, as to the ban on smoking on parks and beaches. The key difference here is that these places are owned (usually) by the gov't, whether it be the federal, state, or local gov't. The law as far as I have read will not affect private beaches (I dunno how many there are up there in NY, down here in Texas we have tons of 'em), which means that if you own a private beach or frequent one, you should be A-OK to light up. Public land has always been considered different, and as the equivalent of a proprietor the gov't has the right to do what they want with it insofar as its constitutionally allowed.

Now, here's where the issue arises for me - ought the state, even on public land, regulate behavior that doesn't affect others in a significant way? Personally I think no, but I can see the argument for it.

Oh man, that brought back memories of high school. Wandering down the hallways and getting nasally assaulted by shitheads in too much cologne or perfume.

Never had much issue with that in highschool, though it did bring this to mind.
Walking towards my 12th grade physics class and suddenly going completely blind, getting shoved into a nearby classroom by my english teacher.
Choking and coughing on police grade pepper spray. Apparently someone brought their father's pepper spray in and doused everyone in the hall.
They sent the 4 of us that were hit dead on to a counselor to document the experience and make sure we didn't have any underlying mental issues from the "traumatic" event. As the happy dappy want to be your buddy must be on some kind of drugs principal said to us.
Guy was always smiling, creeped me out when he'd wave in the hall. Especially considering the history of my extended family with that particular highschool.

I think banning smoking on beaches and in parks is more legit than banning it in bars.

They are publicly owned places with precedence for limiting what you can do there. Not mention how big of an issue cigarette littering is in these place (especially beaches), not to mention the fire hazard that cigarettes have proven to be in parks around the nations.

You're really going to use fire hazard as an arguement for new york? LOL.
As for the litter part, there are litter laws already in place that aren't being enforced that don't impede on the rights of others.
