2 takeaways:

1. clearly NYTimes didnt use his interview in their timeline of the first killing, where Gomer is very pro-Kyle per his in court testimony, all they used was a short clip of him stating he may have shot too.

2. in the second killing phase of the case Gomer may have a lot less pro-Kyle things to say when recalled.

u r correct i believe, i cant find any info showing the charge can be lowered. other than it would need to be approved i think by the defense, which obviously they wont do as murder is a higher bar to clear.
