If congress passes a law that supercedes any executive order. Executive orders are orders on how to go about enforcing laws passed by congress. So if congress says something no longer exists, then your EO on how to enforce it becomes null.
Basic civics bro.
"Executive orders are orders on how to go about enforcing laws passed by congress."
Ah, so let's go back to how the vaccine mandate is "Constitutional" when it usurps the direct power given to Congress to "regulate interstate commerce", and goes above and beyond to outright dictate to any employer with 100 plus employees that they must act as an enforcement arm of the executive branch or suffer massive fines.
Go on. I'm waiting. We're waiting. Especially given that 1.3 million nurses were laid off or furloughed in 2020, and we see upwards of 20% of the remainder fired if they don't get the vaccine, which they're actively REFUSING. What's up, dude? Is it about the health of the populace, or is it about authoritarianism? Is it about the technicality of an EO, or it's content?
As it turns out, Obama had an EO that removed the ability of ICE to catch and remove illegal aliens from the US. That was within his purview, and challenges failed. The method in which you ENFORCE the law is within Executive purview. What's up regarding the vaccine mandate?
