So what's the takeaway when the executive branch teabags the corpse of state and local governments, the legislature and judiciary in order to unilaterally ban large sodas and junk food and mandate every American to eat a serving of vegetables at every meal or else lose their job and be given large fines. After all, obesity is the true #1 killer of Americans, and the real story behind the Covid-19 death rate.

The constitution doesn't give slopes, it gives cliffs. Its articles and amendments are absolutes, not guidelines. Either the executive has an authority or it doesn't. If the executive can do anything he wants with no regard for checks and balances or jurisdiction, then the constitution is just a piece of paper.

TBH, it will be interesting to see how SCOTUS (assuming a case based on this decision today makes it to their docket) interprets Jacobsen v Massachusetts, since that case applies to a state's right within its own borders. This is nationwide.
