Those are the actual legal definitions there on what 'sexually explicit material' means, and it requires either;

(ii) such other person engaging in sexual conduct as defined in subdivision ten of section 130.00 of this chapter with another person; and
I don't see how that bit leaves wiggle room for anyone wiggling their bits. If they're clothed and not exposing genitals, (i) doesn't apply. If its a solo act, (ii) doesn't apply.
Under those definitions, if CNN uploaded footage of Kamala Harris blowing a dildo, it wouldn't be protected.

iirc that case had more to do with liability and lack of consequence. She got injured by her own clumsiness, with no causal relationship to SBC's actions.
