FYI not all laws are based on damages but perceived. Attempted murder carries intentions to do harm, not driving at certain speed limit even though you don't cause harm to anyone is also an offence as examples.
Derogatory comments like musk drinking his own piss without explicit joke/parody warning and impersonating him to manipulate elections is akin to a local newspaper saying Joe biden revealed he likes to drink his own piss and secretly would like Trump to come back into office.
