Also, it seems to me that it doesn't really matter whether states abolish the death penalty or not, I mean, if a case has been turned into a federal one, such as when the FBI is involved, one can still be sentenced to death, regardless of the state he's from.
I learned this from the case of Yingying Zhang's abduction and murder.

Texas alone has killed 570 people from 1976-2020. (570 out of 932 sentenced) 62.2%
Numbers and facts matter a lot more than "well it can still happen so why bother".
