Well, the DA agrees with me because he was only charged with burglary. Realistically, he'll probably plead guilty to unlawful entry or something like that and be cut loose since there are bigger fish to fry.

DA also needs to prove crime beyond a reasonable doubt. You are arguing with people here who would probably volunteer for the shooting squad.
