But I am right though, he lacked the criminal intent, which is required to secure a criminal conviction. He should be locked up, but not in a prison.

i hope that kind of precedent isn't set here, that's a slap in the face to society and the victims

Your country already follows that. The famous serial killer Ed Gein was sent to a mental asylum instead of a prison.

No. I think they should be managed appropriately, which doesn't sound like it happened here due to the agency the kid was with placing him in the school despite his mothers concerns about it. I don't know what their reasoning was for doing it but IMO they are largely to blame for this happening by doing so. They are at least a large part of the equation that is being left out of the conversation.

Were he being managed appropriately and something like this happened i think his level of care/supervision/restraint would need to be upgraded, because this happened in a place he shouldn't have been to begin with (In my opinion) I think it should be taken into consideration, along with his mental condition, before deciding how he should be dealt with.

Yeah basically, or at least returned to his previous level of care. I think it is strange that despite being 17 when it happened he is being charged as an adult because he turned 18 in custody, I don't know the standard procedure for that so I assume it is normal but it seems messed up in this situation

The reality is he should never have been in the school to begin with. You guys are so focused on how to punish this guy whether you want him to die in jail or live in a mental institution, either way the public doesn’t need to fear this guy, anymore. It’s ultimately a distractor from the more important point which is how to prevent it from happening again. He’s not the only severely autistic child in Florida.

'because this happened in a place he shouldn't have been to begin with' you wouldn't of thought or said that if he didn't put her in a coma. you'd be here saying he deserves a chance to be in the public realm. well, look what happened. and it'll happen again
