Meh i think they are setting it up to fail asking for the death penalty here.


But for me, it doesn't make sense from a cost perspective.

Death row inmate cost (60-70k annual) probably for decades, as well as huge legal fees with all the appeals
Federal prison inmate cost (~35k annual)

Life sentence is IMO more appropriate, personally i do think parole should also be offered after some time i.e. 20 years

You make him bigger than he should be by asking for the death penalty. This is going to garner way more attention, way more lionization. Idk dumb approach.

Give him 25 to life and don't make it into a spectacle. You already know Netflix is licking their chops about a documentary that will prob frame him into a robin hood like figure.

I still think seeking the death penalty with a NY jury is going to hurt the Federal Governments case.
It's a really extraordinary response by the Feds in the current era given the totality of the circumstances.
Usually you have to murder multiple people, or torture to death someone in a really heinous manner on land ceded to the Federal Government.
I don't know how they can do jury selection to eliminate objectors as is, and am not 100% sure all of the 'states' evidence will be admitted at this point.
He did pick one hell of a target, its like asking a jury to convict someone for murdering Adolf Hitler.

Darn I can't think of any possible way that deporting an innocent father could have been avoided. There's just no possible mechanisms in place that I can think of.
