I think the guy is losing his backbone, sounds to me like he's more concerned with going with the flow of the political winds rather than being ideologically and philosophically consistent.
It's not THAT simple but that's the brunt of it. Roberts did say that the law, in a vacuum, is fine. The problem is that Louisiana intentionally did this to shut down almost all abortion clinics in the state. That WOULD violate PP vs. Casey which IS precedent.
On the other hand, Roberts did hand us a victory by allowing scholarships to be used for ANY private school (including religious ones!)
I've long held the belief that SCOTUS has gone too far with their separation of church and state attitude. You can't intentionally discriminate against religious institutions if the primary purpose of the funds is secular.
