the process of which i was referring to last night hasnt been used, its a theoretical legal loophole.
basically u convince the secretary of state to not sign off on the election results based on fraud allegations and ongoing court proceedings, that's step 1. the results can not be signed off on (thus calling for GA SoS to step down immediately). Then as there is no verified vote count there is no state winner. at this point as the electoral college vote draws near, if there is still no verified vote count, both the democratic and republican party sent a delegation of electors to the college vote. because there is no "will of the people" because the vote isnt verified by signature, the House must then vote on who is the legitimate delegation in place of the voters. However this is not a case where each House rep gets 1 vote, each state gets 1 vote which is settled by the majority party of that state (Cali gets 1 DNC controlled vote, Alabama 1 GOP controlled vote, etc). Voting this way the GOP actually controls the house as well.
so essentially, if 2-3 SoS's can be convinced or manipulated into not signing off on the election for their state under the guise of "the court hasnt ruled on it and/or fraud seems clear" (as a political spin) then the house chooses who gets those votes, not the voters. but still not a faithless elector, similar but not the same.
faithless elector = elector ignores the will, subject to state laws based on going against the SoS signed election results.
That's a theoretical possiblity, but let's be real: why the fuck should the GOP do this? Almost the entire party apparatus didnt want Trump back in 2016, and the 2020 election couldnt have gone any better for them: Trump gone, but it was close and not a blowout, all while the party held the Senate, made inroads in the House and won all the state legislatures which were in play, meaning they will have the upper hand in redistricting and can sit comfortably on gerrymandered maps for another decade.
Why should they risk all of that by blatantly stealing this election? Can you imagine the blue tsunami in 2022 if Trump is kept in office in this fashion?
The way I see it, the GOP is only hesitantly going along with these court challenges because they need the base to remain amped up for the Georgia runoffs, and because they need to gain time so that the outrage among Trump's base fizzles out instead of devolving into riots or violence. Remember this scene from Star Wars Episode III, where Palpatine turns on Count Dooku and tells his young new apprentice to kill him off because he's outlived his usefulness? I expect this scene to play out very soon, with McConnell being the Emperor and Trump being Dooku.
