legislators subjectively define what is a hate crime. subjective doesnt mean there isnt an overwhelming consensus, it means its not something you can prove 100%.

and overall hate crime is an addition to a regular charge. i can stand outside with a sign that says "god hates fags" and thats not a crime, if i beat a straight person with it that's assault, if i beat a gay person with it that's assault with a hate crime on top.
