that camera angle is a bit misleading. I think the photographer is still 6ft away from him. and it's outdoors, and not a prolonged exposure, just for a few seconds.

Yea, I think that's nonsense. I really don't think a Democratic agenda is really in jeopardy. Let's take the more unlikely things: Puerto Rico as a state? Easily constitutional. Public option? We already have Medicaid. Green New Deal stuff? Most of it is increased spending.

The interesting thing would be federal mandates regarding voting rights. The Roberts court has been pretty stingy when it comes to any sort of national enforcement. There's also some concerns regarding administrative law (see Chevron Deference) but that just means Congress would have to do their job better.
