Because even if he had totally declassified them you still aren't allowed to be in possession of information about national security you aren't allowed to have access to, and you aren't allowed to retain documents you don't lawfully own, and you aren't allowed to obstruct an investigation or the process of finding those documents.

and here's the kicker, if Trump can declassify them by just thinking about it, Biden can reclassify them by thinking about it the second he gets in office. So there is no leg to stand on regarding those documents. If they have all the classification markings and the current president thinks they're classified.... then you can do the math.

The charges are dropped because as we know, a president can declassify documents by thinking about it even with no notification.

All documents up until 2028 become public records as they are not classified. The federal government is sued under FOIA for not releasing all documents during that time period because they were all declassified.
