It's alive in the most literal definition of the word but it isn't the kind of life we assign rights to.
A tumor isn't a biological individual but it is very much alive. An embryo destined for miscarriage clearly has value b/c pregnant women cry like little bitches when you kick them in the uterus for being out of line. Frozen embryos also have value b/c if I let them all die, there will be a lot of upset gay/biologically unfit couples.
Anyway, we assign different rights to individuals depending on the age. You can be charged with murdering a fetus in many states. You can't vote until you're 18. You can't drink until you're 21. You can't give sexual consent until you're 15. Hell, Roe basically gave us an outline for when the State can give rights to fetuses.
