Well, subtle disingenuity like that does undermine the point the comic is trying to make.

The nitpicking aside, I dont think the point is very convincing anyway. Both pictures represent one facet of American society and sentiment.
The reality of the situation has a lot more ambiguity than "Trump's America = bad (militaristic, hostile, cold, authoritarian)" vs "Protesters' America = good (peaceful, colorful, lots of diversity of both people and opinion)".

The point is that one of these signifies the ideal of America more than the other. Freedom of speech fulfills that ideal more than the militaristic trump's America.
