That's really the greatest irony about it:

Without Hillary Clinton smugly campaigning on the assumption that she "doesn't need white men", Roe doesn't fall.
Without the selfishness of RBG, who as an over 80 year old, multiple time cancer survivor refused to step down while Democrats still had the power to nominate a liberal, pro-choice successor, Roe doesn't fall.

The hubris of two women who have been lionized as liberal and feminist icons for decades will end up enabling to the biggest setback for women's rights in at least a generation.



Going forward, I expect that the example set by justices Kennedy and Breyer will become the norm, with Supreme Court justices stepping down between their mid-70s and early 80s whenever the political moment is opportune. The GOP is all but guaranteed to control the Senate after 2024, so if they also win back the White House, I fully expect pressure on Thomas to step down, perhaps also on Alito.

An infant is a human being which can exist independently from its mother. It can be raised by the father or other family members, by foster parents or even complete strangers. That's pretty much the ethical line I, personally, would draw when it comes to abortion. It follows from this argument that abortion should definitely be illegal after the time when the life of the fetus could be saved by modern medicine in case the mother died, roughly 24 weeks or 6 months into the pregnancy.

Any earlier deadline for abortions requires moral or religious arguments.

Predicating rights on whether or not there's a surrogate available, or whether a particular jurisdiction has the requisite medical care is building those "rights" on a pillar of sand. Access to modern medicine varies, the technology itself evolves. Does an infant have rights in a 3rd world country? Will a zygote have rights in ~50 years? If we've accepted that humans have rights, we need to determine what it means to be human. The rest is irrelevant.
