Judicial shopping is the inevitable consequence of an increasingly politicized judiciary in an increasingly polarized country.

Over the long run, court opinion will reflect the majority opinion of the people within their jurisdiction, at least as long as there is a clear majority on the issue at hand.
When different states and regions trend in opposite directions politically and in terms of worldview, then their courts will trend apart as well.

This wouldnt be such an issue if courts only had to settle technocratic questions, or if the country had a written legal code (civil law system) instead of the precedent-based common law system.
It also wouldnt be such an issue if Congress wasnt so notoriously gridlocked and unable to settle political questions, which is the main reason why so many fundamentally political cases have to be settled in court instead of the legislatures.
And it also wouldnt be such an issue if there werent so many activist judges who embrace the idea of "governing from the benches".
