I guess his argument is that it's the minorities are disadvantaged more often than the underperforming white children.

The people should have a right to dictate state policy. The Court reaffirmed that right.

Uh, this isn't about individual rights. It's about admissions policy....which the people should have a say in. Want to get in? Work hard and be smart.

Tell that to the bottom percentile that Affirmative Applies to. It is hard to apply that to people who are the lowest passable scorers on tests biased in their favor.

Aid can be conditioned on disadvantage without also conditioning it on the color of your skin. Michigan's admissions policies gave as many points for admission for being black as it did for a perfect SAT score.
