yes because if they raided somewhere they had a warrant. there's a difference between breaking into a house (even the wrong one) when a judge gave you permission to enter a house.

i'm guessing however that the family sued and won against the police dept. not a great outcome but better than a dead dog and no apology.

It's almost impossible to sue police

I realize Forbes is not a credible source. It was the first article on Google for the case I was thinking of.

jesus what a fucking wonky case. especially the quagmire of whether the boys 4th amendment rights were violated being unknowable because he was not arrested, suspected, or targeted.

basically the tl;dr would be, "dad arrested and convicted on violence against a cop (preapproved use of force during a raid arrest). but since child wasn't targeted they can't put it to a jury to confirm/deny the story of the family." what's not in the article, at least that i saw, is that the officer likely staunchly disagrees with the victims story.

it is fairly easy to sue cops tho, just hard to win. if you've been arrested you have a case for a suit as you're automatically tied into 4th amendment protections.

another miscarriage of justice

cop is arguably one of the more awful jobs and brainless shit like this makes it harder for any decent individual to bother with working in that field. imagine your co-worker is so inept he hits a 10-year old human being instead of whatever else he was “aiming at”
