there's still something clearly malicious about the Flynn case revealed by this latest development
Prosecution was required to turn over all Brady / Giglio materials during discovery and said they complied

after Flynn stopped being cooperative, in the middle of the trial, the prosecution magically got a statement from the intelligence community saying they had secret evidence alleging Flynn had a relationship with Alptekin relating to Turkey's attempt to influence policy. Except they didn't actually provide this evidence, just a statement they have the evidence. Which of course would have had to have been turned over in discovery if the prosecution had it. But the prosecution can plead ignorance and say they never had it until the IC gave it to them right now, and as long as the left hand of the government pretends it doesn't know what the right hand was doing, they can try to ambush a defendant with surprise evidence that cannot possibly be defended against because you get neither chance to examine it nor respond to it.
I'm trying to understand how any judge anywhere in America could allow a farce like this and pretend due process is being upheld.
As the article lays out, for the pretense of compliance with discovery to be held up, it would also have to show that Mueller's team was never even looped into accusations against Flynn in the first place, meaning their prosecution of him was done without having a clue about IC suspicions, otherwise they'd have to turn it over. And the fact that they only turned it over once Flynn became their enemy again showed it was purely a political consideration and being used for revenge.

but ignore that and just look at the due process.
The government could violate discovery on demand by simply compartmentalizing evidence and dripping it out only as needed for maximum impact during a trial. Just get the lawyers to cover their eyes and have someone in the IC wink and nod and they can keep dropping it throughout the trial without ever giving the defendant a heads up. And then because its 'classified' evidence from the IC, they don't need to present the evidence at all. Just a claim that they have it. What is it? You can't see it. A regular ol Star Chamber.
