Im not sure. Credible threats are obviously illegal under some very specific precedents establishing the criterion. But does facebook incur a liability by facilitating and explicitly allowing such threats? I imagine legally, they could just parse out that their community guidelines only permit legal, non specific/credible threats, while excluding illegal threats under other terms of service that undoubtably have a clause saying no illegal content.
But activist judges and overzealous prosecutors have made more tortured cases in the past.
If they can go after the daily stormer for harassing someone, they could go after facebook for allowing threats
