https://www.foxnews.com/us/medic-testifies-that-he-not-navy-seal-eddie-gallagher-was-responsible-for-isis-fighters-death>prosecutors give a SEAL team medic immunity so he can testify that Eddie Gallagher killed the ISIS militant
>he gives his testimony as the prosecutors wanted it
>goes to cross examination
>under cross, says that
he is the one who killed the militant>now he's got both immunity and isn't treated as a hostile witness since he already testified against gallagher
>testifies that the prosecution didn't actually ask him the cause of death, and that the cause of death was him, the medic, purposefully asphyxiating the militant by covering his breathing tube until he suffocated
>but does testify that the militant would have died anyway, and he was mercy killing him
ahhh the old bait and switch.
this fucking story reads like an episode of Law and Order. i'm surprised there aren't identical twins trying to exploit double jeopardy with the old double confession trick.
actually a case i observed in undergrad tried similar. Undercover cop bought drugs off the accused, who lived in a trailer with about 5 relatives. all 5 of them in court, and all 5 were pudgy 5'5"-ish white people with light brown mullets. Their defense? since they all look the same the accuser couldn't possibly identify who sold him the drugs. Since then i've been convinced they spent months all growing their hair out and got it all cut identically for court. I'm not sure what fucking public defender jumped on that grenade of a case but im sure he said to plea and then said "well this if fucking stupid but if you wont plea....."
