Intent doesn't just mean intent to do harm directly to civilians, it means intent to carry out the act that led to that harm. Just like intent in criminal trials, you don't have to have intended to kill someone to be charged with intentional homicide, you just have to have intended to carry out the act which led to it.

"Law" between sovereigns is a weird area. It's hard to say what's a crime and what isn't when you're dealing with entities who create the law.

If anything bombing of dresden is just a poor example. The RAF bombed and sank at least one hospital ship.
US army massacring POWs in Pacific and European theatres, raped women in occupied Japan.

Those are undeniably war crimes.
