I do think it is interesting that textualists like Gorsuch make reference to what lawmakers might have wanted or meant in their opinions. I've maintained textualism and originalism are mutually exclusive ideologies, yet Conservatives judges frequently refer to themselves as both.

Meanwhile, Alito is reeee'ing in his dissent about bathrooms.


You can't be both i agree and that is why so many conservative justices seem schizophrenic, scalia was the worse.

They are like " the words mean this in this case but in this one my ouija board says he meant this".

Liberal judicial ideology is antithetical with a republican mode of government insofar as it subverts the ability of the people to effect change via the legislature. That is the conservative position, that power is vested in the legislature to write laws, and not in a handful of god-kings on the bench.

That's some really shallow social commentary, though.

I don't think it's necessarily that black and white but I tend to agree with you. Legislatures need to take grow a pair.
