You're overly emotional, lol. Your loaded question of "who did he actually hurt on that train" is unjustified, this was a clear-cut self-defense situation which escalated within seconds and ended in tragedy. Nothing more, nothing less.


Self defense from what? I'm sorry the people are the right are so scared of their own shadows they fear for their life if a homeless man yells a little too loudly.

if it is what it appears though, that's second degree manslaughter to me. the guy chose to physically engage the crazy person, he knew what he was doing, and he must have kept choking a limp body for minutes. that's not an "accident" not a "heat of the moment" thing to me - or anyone who knows the slightest bit about submissions for that matter...

i read a bit more into the case, and according to witness testimony, the crazy person did not just threaten people verbally, he actually fake-lunged at them several times and moved around erratically - and although he apparently did not actually attack anyone, i would consider that a real enough threat to justify a physical confrontation, aiming to neutralise the threat he represents.

so personally, i think it's fair to describe that as self-defence.

it actually paints a picture of him trying to get arrested, or maybe provoke a physical altercation - if any such "planning" was even within his capabilities at the point - but that is not something i would reasonably expect anyone in the situation to account for or rationally evaluate.

in reality, after unconsciousness first come increasing degrees of brain damage (starting roughly a minute into interrupting blood flow to the brain) - and only after about five (!) minutes of actively choking their lifeless body comes death.

also, when you wake up from being choked out like that, it takes quite a while to gather your bearings - let alone the strength to magically overwhelm several grown men, one of which still has you in a hold you couldn't escape in the first place.

literally everything in your description is framed to lead to your desired conclusion and rife with ignorance and bias. no nuance, no effort to educate yourself...

Neely, a disgruntled man threatening women and children in an enclosed space, is still conscious and struggling+kicking to break free from restraint from multiple people until around 2:07 and is released at 2:57. that's not "five (!) minutes of actively choking their lifeless body", and Penny goes as far as to place him in a recovery position afterwards. They clearly did not intend to kill him after he was no longer an active threat.

In my opinion, the man distracting the good samaritans with warnings about legal ramifications probably prolonged the chokehold and most likely resulted in Neely's death. If he really cared, he could have attempted to physically break them up at that exact moment instead of becoming an impromptu defense attorney.

The guy was chocked to death: this is definitely not a success story for a trained veteran, he's lucky to not have been condemned for his "fuckoff samaritain manners" . End of story, next please.

There was a history of attacks apparently

In 2021, Neely socked a 67-year-old woman as she exited the Bowery station in the East Village in Lower Manhattan.

The woman sustained a broken nose, a fractured orbital bone, and "bruising, swelling and substantial pain to the back of her head" in the Nov. 12 attack, according to a criminal complaint.

He successfully defended innocent people from somebody unhinged acting violently. I'd call that a success. It obviously wasn't a happy ending for the guy harassing everyone on the train, which in his own mind seemed to be going to jail for attacking people.
