WTF?! Why without prejudice.

Defense* are idiots. Hopefully the judge waits for what the jury has to say and they make the right decision before even considering a mistrial.

The defense does not have the facts to prove malicious conduct regarding the altered video being provided by the State. Therefore it's a basic "the state is stupid" mistrial request.

I don't think I would have made a motion for mistrial. This is... Yeah, nightmare scenario here.

If were chasing truth as the judge mentioned earlier what is the issue?

Isn't that the intention of the court, to find truth? If Kyle pointed the gun at him before he was even chasing him and he provoked the attack, so be it, the Jury should be able to review that over and over in all its high definition.

The high def footage doesn't show that, is the basic issue. Had they had the high def footage, they could have proven that the state's provocation claim was fabricated.

Okay, I see I must have misunderstood jumping in half way. I thought it the HD was just a better image of him pointing the gun.

The prosecution basically has an offsides penalty giving the rittenhouse team a free play with the jury.
If the jury convicts they appeal with an incredible case for mistrial
if he is found not guilty everything is cool

They are probably worried the judge wouldn't grant a mistrial after a verdict is found. hes hesitated and copped out so far..
