the jury is deliberating on a video on bottom, but the defense made their case based on the top one being in evidence. they're rewatching videos on the jury room, but the defense didnt even have the clear one nor were they able to question witnesses based on it.

They used the high resolution video as the sole basis for their provocation argument, on details already blurry beyond recognition in the 'higher' resolution video and obviously not visible in the 212p video. So they sandbagged the defense on their primary evidence, which itself was already bogus- the upscaling they used in Amped 5 came with a disclaimer in its user manual saying the AI upscaling was only to be used for forensic purposes cannot be used for evidentiary purposes at trial. Its one of the several points raised, the others being the 5th amendment violations and prosecutors bringing up excluded evidence on cross.

did the defense include the fact that Binger clearly has 5% rodent DNA or more in their dismissal request?

clear on the 1080p that Kyle returned to teabag his VICTIM call of duty style but was blocked by peaceful protesters.

It was actually a truck mirror, that mirror was used to frame Kyle that he aimed a rifle before the chase.
He was actually turned the other way and not raising anything.

In order for the blurry photo to work Kyle would have also needed to be left handed. Which he's not.

BUT we have the HD footage showing the Zaminskis yelling at Kyle and him NOT raising his weapon then Rosenbaum comes out to chase him

the claim that rosenbum was so provoked by Kyle that he had to chase him across an empty parking lot and try and disarm him was always bunk.

IF, and that's a hypothetical IF, kyle did point at rosenbum, he then ran the fuck away. tore off in the opposite direction. at which time rosenbum chases him hundreds of feet into a corner where Kyle can't escape and keeps charging.

if kyle is convicted on the first count of murder i dont know what to even say, its insane to think someone could mentally play through that sequence and come away with a murder charge. you have to suspend all knowledge of what happened, and implant "he shouldnt have been there so he's guilty of everything that happens once he's there".
