The senate confirmed Eric Miller to the 9th circuit today in a 53-46 vote.
This is the first time a president has nominated a lower court judge overriding the blue slip courtesy of both state senators, this time Murray & Cantwell from Washington. Blue slips went to the forefront after first Harry Reid went nuclear and then when Trump took office, Franken became the first to say he would use his blue slip on any and all Trump appointees- to which McConnell laughed and bowled right over him, or at least would have if Franken hadn't exploded into flames and disintegrated first.
But the timeline from this blue slip fight over the nomination to the 9th circuit is just insane. I dare anyone to actually read these sequence of events and pretend the democrats aren't 100% as obstructionist as the republicans were under Obama, or more.

  • April 12, 2017: Don McGahn speaks to Murray about the need to fill the three Washington vacancies.
  • August 15th, 2017: Judge Tallman announces his intent to take senior status come March 3rd 2018
  • August 23, 2017: White House emails Murray's staff a list of six qualified candidates, asking for input and advice
  • October 5th, 2017: White house staff send another follow-up email, including the names and resumes, reminding they need input by Dec. 1st for picks by the end of the year
  • November 13th, 2017: White house finally meet with Murray again, and learn that in those 3 months Murray did not talk to a single one of the candidates. No interviews or actions had been take at all. They ask for another week to review writings by the candidates, which they are given.
  • December 7th, 2017: McGahn calls Murray, and Murray proposes a deal: She'll support Miller's nomination and one white-house-preferred district court candidate if the white house supports two out of five district court candidates from a list of those she approves. They reach a tentative agreement and she says she'll coordinate to interview the picks
  • December 13th, 2017: McGahn calls Cantwell and loops her in on the agreement and asks her to review the candidates
  • January 4th, 2018: White house reach out to both offices and get no response
  • January 16th, 2018: White house reach out to both offices and get no response
  • January 29th, 2018: White house reach out to both offices and get no response
  • February 1st, 2018: White house reach out to both offices and get no response
  • February 7th, 2018: White house reach out and get a response from Murray, who agrees to meet
  • February 9th, 2018: White house meet with Murray, who agree to a deal to confirm Mill, Gorman, O'Sullivan and one more candidate of their choice from the White House's preferred lis of names. They assure the white house they'll be ready for final approval by the 16th
  • February 16th, 2018: White house reach out to both offices and get no response
  • February 20th, 2018: White house reach out to both offices and get an apology asking for a few more days
  • February 23rd, 2018: White house reach out to both offices and get no response
  • February 26th, 2018: White house reach out to both offices and get no response
  • April 26th, 2018: McGahn calls Murray and they agree to start background investigations
  • July 11th, 2018: McGahn calls Murray and says as a show of good faith the white house will nominate both the liberal judges and miller without the democrats having picked the last preferred candidate from the white house's list yet.
  • July 12th, 2018: Murray contacts the white house and says they agree to the deal of Miller, Gorman & O'Sullivan, with the last pick still pending.
  • July 13th, 2018: The white house officially announces the three picks. Murray then calls the white house to express unhappiness with Miller's pick, saying no agreement had been agreed to, only the district court nominees (what the actual fuck)
  • July 18th, 2018: McGahn calls Murray to try to sort out any possible miscommunication. Murray denies knowledge of any Eric Miller or 9th Circuit vacancy discussions. McGahn reminds Murray that he literally has a transcript of what he said to her about confirming Miller and the exact line. Murray then miraculously remembers that McGahn and mentioned an Eric Miller. But said that the White House had not indicated they wished to nominate him, even though that was the entire point of the deal they had worked on for a year at this point.
  • October 18th, 2018: Grassley publishes that scathing-as-fuck letter
  • October 24th, 2018: The Senate Judiciary Committee holds a hearing on Miller
  • October 29th, 2018: The ABA ranks Miller as unanimously well qualified
  • January 3rd, 2019: Congress adjourns and retables the nomination to Trump
  • January 23rd, 2019: Trump re-nominates Miller
  • February 7th, 2019: The Senate Judiciary Committee favorably reports Miller's nomination
  • February 26th, 2019: Eric Miller is confirmed and sworn into the 9th circuit, having never received a blue slip from either of his state's senators

Obama's was sold as hope for the future

Trump's was sold on embracing an ugly past

I'm sure there were isolated incidents of scuffles over political attire as happens in a toxic political environment but I know for sure there were countless incidents of vandalism and thievery when it came to lawn signs and car decor and the like for political support of Obama. This was before the Confederate flag decorations were replaced/enhanced with maga decor


And then of course there were the protests where maga folks hung Obama dolls and had their go back to Africa signs and the like

When you spend a very large majoirty of your time running on the worst of America and emboldening those that represent it you've earned the toxicity of your slogan

He didn't run a positive campaign he ran a purely negative campaign

supporting torture and irrational versions of walls and seperation, talking about shooting people and getting away with it, supporting the old ways of policing which was brutality and injustice

talking about paying legal fees for violence, bombing the hell out of people, "lock her up" chants of no due process that moved even past clinton to a warcry of right wingers that just want to lock up political opposition

switching awareness for police brutality into disrespecting soldiers and hating america which is a flat out malicious lie

painting undocumented immigrants with a hateful brush to push them as a boogeyman destroying the country and raping the population while he profited his entire life off undocumented labor

The king birther a vicious hateful racist campaign against the president of the united states

He embraced hate and emboldened the hateful and he deserves every negative thing said about that slogan and that red cap.

The right will say uhhh he meant jobs and economy. He is destroying the midwest with an incompetent trade war. He is a failure and a racist that does embrace an ugly past and he ran on it and it was successful

mocking of massacres against unarmed native women and children by the very government he commands over a childish fight he started with another politician

but keep talking about some red hats getting flipped off some heads and some isolated incidents of scuffles in an environment of hostility that he has played a massive role in as if the victims are white conservatives that howl like angry hyenas at his hate rallies
