Dude, this isn't a hard concept.

If you show up with an intention to commit violence you lose the right to self defense.

Kyle got his gun from and traveled with an extremist group who's intention was to commit violence. The defense is going to argue that Kyle was a dumb kid who didn't have bad intention and got mixed with a bad crowd. The prosecution is going to argue he was with them for a reason. The jury will decide which is more likely.

I already said that knowing what I know I'd err on the side of being a dumb kid.

Indeed it isn't. If the video shows excellent self control then that could be a point for the defense. But it doesn't matter what you or I think. It's up to the jury to decide. If Kyle had gone there on his own we probalby wouldn't even be having a trial on it. He would have plead guilty on the illegal gun stuff and gotten a light sentence. There's a reason we're having a trial, and that reason is it's not an open and shut case like so many are trying to portray it as.



Yes, that is the burden of the prosecution, and if they can't meet that burden based on the evidence then Kyle will walk free on the murder charges.
