Indeed it isn't. If the video shows excellent self control then that could be a point for the defense. But it doesn't matter what you or I think. It's up to the jury to decide. If Kyle had gone there on his own we probalby wouldn't even be having a trial on it. He would have plead guilty on the illegal gun stuff and gotten a light sentence. There's a reason we're having a trial, and that reason is it's not an open and shut case like so many are trying to portray it as.

Yes, that is the burden of the prosecution, and if they can't meet that burden based on the evidence then Kyle will walk free on the murder charges.
