State should stay out of it all ideally and just be the sandbox we play in together in the social contract (imo). I like this law.
One of the biggest lessons in my meager two semesters of sociology is that when the government tries to help people it ends up hurting people (welfare, affirmative action), and when the government tries to stop people it assist them by forcing them to specialize in the face of adversity (Alien Land Laws, Chinese Exclusion Act, which effectively made it so Chinese-Americans couldn't do anything but own restaurants and Laundromats in certain geographical areas).
Indeed. The proposition is so specific though. They were seeking to make it so that state and local governments themselves could discriminate (and yes, providing preferential treatment is also discrimination). This particular proposition has nothing to do with the Private Market. However, if it passes, it will undoubtedly be used against the private market. Seeing measures such as this [hopefully] fail gives me hope that California is not completely lost afterall.

So basically it's looking like media outlets will be able to call PA pretty soon?
I wouldn't expect to know a winner for sure until January, tbh. Recounts, lawsuits, and more are far too likely at this point.
