Some of it might, but some of it is so brazen that it's unlikely to be overturned. The meat is more in the specific amount of damages rather than if it happened. I could see him getting off in Mar A Lago. But he's never getting away with tripling the size of his apartment.

It's kind of hard to tell because a lot of the judge refusing to allow them to make certain arguments was the lawyers being really really shitty at their jobs.

Like, maybe they should have been allowed to bring in bids or other evaluations, but if they didn't do it the right way, that doesn't really matter. And from what I read they were doing basically nothing the right way and really pissing off the judge with a ton of frivilous motions.

So it may well be the case that they can't appeal it because they didn't follow the proper procedure to lay its foundation, and the judge is fine on that ruling.

i dont logically see why they wouldnt be allowed to expand discovery under appeal, but this is a state level civil case, so frankly i have no idea the rules of discovery surrounding that.

I don't know New York specifically, but in general you can't bring new evidence on appeals unless there is a specific exception. So if the judge made a mistake, or if there was some outside factor that made it impossible to access.

So if they want to bring it in, it's gonna be on them to find that exception and get it in. Appeals aren't just for "we did a shitty job, let us bring in more things".

you can't present new evidence you didn't try to before. it seems they did try, and it was dismissed. dismissed and never entered arent the same thing. but im not 100% sure on the timeline nor NY law so its just conjecture from someone way too rusty on this.

motion for appeal under the argument evidence was dismissed that shouldnt be is a common appeal afaik. but no clue on commonality in civil fraud cases. civil cases in general are odd.

Yeah they'll have to prove the judge made a mistake. So, balls in their court. I'd say Trump should hire a better legal team for the appeal but he kind of screwed himself out of good representation by not paying people.

Appeals is gonna be real friggin technical and hard to follow. Gonna be dependent on how the law is interpreted with regards to the judge's specific rulings. So... I doubt we'll hear much about it until it's over and then might see a Legal Eagle video on it.
