I don’t think the question is whether or not the robber’s life is worth more than the phone.

The question is did the robber give up his rights to that life when he robbed the driver.

And the answer is, undoubtedly yes.

That said, I reserve openness to the death penalty for those who just leave their shopping cart in random parking spots rather than returning them.

I was more referring to my example of your hand is on my phone struggling for it and getting your face blown off.

The OP is like an after the fact thing I doubt that would be okay in Texas.
