You're just using the same line of reasoning as people who say "We can't give any kind of special treatment to previously oppressed communities because that would be racist!"

Nah, actively undoing the history of racism is only racist if you're wanting to weaponize the concept instead of approaching it honestly.

It is racist though. Let's forget white men who have historically been overrepresented, no tears for them. There are other minority demographics that have been just as underrepresented. Is it fair to Asian, Latino, Native or fill in the blank underrepresented sub-demographic when I'm only going to consider people of one gender and race and exclude them (again)?

This country was made by whites for whites.
It isn't racism that made it that way.
Facts, logic and history did.

If Thomas kicks the bucket we can replace him with one of those.

Are we to believe that the Biden admin looked at all possible candidates, male or female, black, white, hispanic, asian or native with an open mind, then concluded that the top candidates from all demographic subgroups are equally qualified and that they could thus afford to pick a black woman for symbolic or reparative reasons? No, of course not. Biden repeatedly promised on the campaign trail that he would nominate a black woman. It's blatantly obvious that only black female candidates were even considered for this nomination. His priorities were undeniably "right skin color and gender first, best qualified person for the job second". Brown Jackson is undisputably an affirmative action nominee.

It's no biggie in this specific case since Brown Jackson is indeed extremely qualified and doesn't seem to have skeletons in her closet, so this AA pick has worked out fine. The principle behind this nomination, namely prioritizing the right demographic profile over finding the best qualification, is nonetheless questionable.

One plus she might have is that she comes from the defense side while most other judges were prosecutors. This could give her a different perspective on cases relating to criminal justice reform. (But then again, this was not the primary reason why Biden picked her!)

Hawley grilled Jackson on Tuesday over a 2013 case, United States v Hawkins, in which she sentenced an 18-year-old male to three months in prison when the federal guidelines had recommended up to 10 years and prosecutors asked for two years. The senator said the defendant had been caught with a large collection of videos and pictures of children as young as eight committing sex acts.

How are we to answer her “soft on pedophelia” approach?

Cant wait to increase my number of children raped from 0 to 0 honestly.

While dumbasses like you turn that one around in your head for a while, you ever going to tell us who abuses more children trans people or religious leaders? Few coins goes on no.

Because Obama was the last democratic president and anyone appounted by Clinton would be too old to be considered for the SC
