Obviously this depends on jurisdiction, but I've had dozens of cases come across my desk so far and none of them have been successful, regardless of the wall of text the employee throws up.

Vaccination status is not a protected ground in my jurisdiction so the employers have been saying no.

I think I have seen two cases where the employees drag their heels and get fired without cause resulting in some severance, but for the most part the employees ragequit and get nothing.

I haven't seen any originating documents for constructive dismissal yet, but that'll keep me busy in the near future. :)

But aren't employers in your country prohibited from inquiring about an employee's medical status? For example, you cannot ask a female worker, "have you ever had an abortion?"
