How many of those people would say yes to sex with a person with HIV without any protection?
The reason for pep is because of assholes outlines in op's post. prep is more for your category imo that know the risks going in.
Neither are being used cause the second party in op's post was not informed.

i kinda agree, but would rephrase it that prep exists because people lie about having HIV or because they dont know they have HIV. so people use it so they can have sex without worrying about lies. i dont think many people would say yes to having sex with someone with HIV at all. unless they're bug chasers, then they're not on prep.

Knit picking aside you get what I'm saying now.
Wasn't concerned tbh about the few exceptions like bug chasers and such.

Dude in ops post got exactly what he deserved, it was not a drastic punishment.
There needs to be examples like this to try and deter others cause clearly people can't be trusted on their own.

Drunk driving has a far higher fatality rate than sex with a condom. So why should the punishment be so much worse for failing to inform?

If someone deliberately tried to infect someone with HIV by having unprotected sex with them, then I would agree, throw the book at them. That should be attempted murder, at least. But while condoms are not 100% effective, as those lobbies are falsely portraying, they ARE usually effective, so the risk is minimal. They still should inform people so that they can make their own informed decision, but I don't think such a strong punishment fits the crime of failure to inform of a small risk.

tbf, a lot of the prep type pills dont work for "people assigned female at birth" (im direct quoting the latest fucking commercial for it directly. just food for thought about prep.

not drunk driving per se, failure to disclose to a passenger that you are intoxicated. thats putting someone else at far greater risk than protected sex with an hiv positive person. people tend to view sex related and biological (infectious) related offences as worse than other offenses, even if theyre statistically less siginificant. theres really no reason to, tho. the statistical rates of occurance should dictate the seriousnessof the punishment for something that was only a risk and resulted in no actual harm, not out feelings about that risk.
