Maybe I'm reading it wrong but if the father is filing for custody as the custodian to take the child from the mother and stay in the US he's got to be either a citizen or legal resident or ICE would just deport them all as a family together. A 3rd party court filing can't possibly give him custody if they can't identify him or his status or even establish his relationship. If he's just another illegal alien too than its a very dumb story, because the only options are deport a 2 year old citizen with her illegal parents or separate a child from its parents and keep her an orphan in the US
Yeah if they were together, they would all be deported together. But if he was a caring father the filing would name him.
The news makes dumb stories out of nothing all the time, but I suspect that the non immediate family is trying to get custody of the child from the mother.
It says right in the story that the father appointed the person filing to be the custodian of the child.
Either way there is no case here for the father even if he were legal to appoint a 3rd party to get custody of the child over the mother.
We've hashed this out like 25 years ago with Elian Gonzales if that's the case.
If the father is legal and just doesn't want responsibility for the child, no worries, child support will still be deducted as if she were in the United States.
