Whether he was free to sue the police was the issue at court. The judge said no. The higher court of appeals said yes.
Its a bit like that slavery comparison, if we still had one lower court judge saying dred scott was precedent in 2023 and a higher court overruling them. The takeaway should be extremely alarming that a judge could sign off on that anywhere in the country
