"The state" refers to the government at large, could be federal or more local. George Floyd's criminal record is basically irrelevant to whether or not the actions of the police officers at the scene were justified. If you were to say "before police officers raided Floyd's home they were aware that he had threated a woman with a firearm", it would be relevant to the officer's actions in that raid. But if they have no knowledge of what he's done before, it's not relevant. Floyd doing bad things in his past does not justify wrongful actions in the present.
