This has been a recurring theme in the modern judiciary across the west. If someone who belongs to a political / ideological / racial / etc faction that the judiciary holds a bias against, they get the book thrown at them for even minor offenses.

Now this is hardly a neologism. The entirety of history is filled with it. All that really sets us apart in the modern day is I think two aspects, one is our holier-than-thou attitude that places modern sensibilities above all else and assumes everyone who came before us was afflicted by moral failings we don't share. The other is the philosophical incoherence. To the latter point, the examples of pedophiles walking free. Its not that the liberal world is super aligned with pedos no matter how much the Trump world would like to make conspiracy theories about it. The bare fact of these being middle aged white men would make them the subject of that prejudice if anything. But instead their identity is simply overlooked and ignored. Its the liberal philosophy that we should be lenient on crime, give people endless second chances, suspended sentences, revolving doors, etc in the name of restorative justice. Its just completely thrown out the window and turned into firebrand old testament draconian justice the minute its applied to their political enemies, anyone they see as sharing conservative beliefs. Someone carrying an illegal firearm they use to pistol whip a victim in Minneapolis will walk free with a suspended sentence. Someone carrying an illegal firearm they use to pistol whip a tranny while screaming that they're a sick pervert, will be thrown in prison for life. And of course that goes to the first point, that our beliefs like gender ideology that contradict 99.9999% of all human historical perspectives (even as recent as 10 years ago) are somehow the only true and permissible beliefs

so yeah they didn't even try to stop BLM rioters torching cars but they want to give these guys 10 years in prison for posting emojis

The judicial system in the west has been long flawed. Historical societies and even modern powers in their heyday would be appalled at the miscarriage of justice that has occurred in the so-called enlightened world.

Isn't it kind of the norm through history? Protestants persecuting catholics, catholics persecuting jews, whites persecuting blacks. Look at the story of John P Slough in the 1860s after the civil war. He was a union brigadier general turned judge put into New Mexico where people despised him, he worked to crush the pseudoslavery peonage system but local juries would refuse to convict people in his courts no matter the evidence. As he took on local corruption, one of his legislative council opponents simply gunned him down in broad daylight with plenty of witnesses, before he could draw his own gun in defense. His assassin was acquitted in a sham trial. That's the constant through history back to the crowd shouting for Barabbas

What I think makes us so special today is how we have this militant ideal of authority. You cannot question the system or your very words are 'dangerous'. Not the dogma of an intolerant religion or a paranoid monarch, that's been done so many times before, now its this kind of absurd concept that our judicial system is so unimpeachable and incorruptible and perfect simply by its own virtue, not the authority from which it derives. We're a perfect democracy, if you want to audit our elections you need to be censored for spreading dangerous misinformation. We have perfect courts, if you think Derek Chauvin was an innocent man you must be deplatformed and your career destroyed. Unless it serves our political interests. Unless its a black man like Myon Burrell, then Tim Walz needs to pardon him. Because like I said, this philosophy is utterly incoherent and schizophrenic and only applied selectively. That's what makes it mad. If you believe in the divine right of an emperor and won't tolerate anyone questioning his commands, at least your worldview makes sense on its own terms.

Ok what I meant by long flawed is after each powerhouse (Britain, US, etc) achieved their “pax Romana”. Mob rule during Rome and when Jesus was condemned to death on the cross was par for the course then. Which is odd because you had Plato and Demosthenes before that basically tee up a proper justice system. And long after that Locke and Aquinas. Then Russell and Dworkin. Anyways that’s waxing philosophy.

Nowadays it very much is mob rule - you are guilty until your prove your innocence. Only difference is when you prove your worth in the mafia you become a made man. In the western justice system you still have your reputation shattered.

I guess the era after the end of the cold war, call it the "end of history"-mindset if you will, has really caused a lot of people to buy into this idea that our judiciary, and our institutions more broadly, are pure and nonpartisan and don't harbor any social or ideological biases. Since 2010 or so, people are increasingly waking up to the reality that this is a myth, and has been all along.
