The GBI wasn't consulted. The legal charges are erroneous and cannot be filed in Georgia and blatantly violate the merger doctrine. He claimed the other cop as a agreeing to be a prosecution witness without his agreement. Every description he gave of the encounter was completely backwards and contradicted by the public video evidence. He made a batshit insane claim that getting fired at by someone who runs out at ammo at the split second you return fire makes a shooting murder instead of self-defense. And the DA is facing felony fraud investigation and sexual misconduct

The same DA Paul Howard just two weeks ago brought charges against other police officers for aggravated assault for using tasers on police officers, arguing that tasers are deadly weapons.
So he contradicted his own legal argument in this case, in which he argues that tasers aren't deadly weapons and thus don't justify lethal force.
And he's on fucking video saying it in both instances.



I cannot wrap my head around what led up to that press conference. What the actual fuck is going on.
I have a feel like we're going to find out that this DA is actually a con-man who fabricated his diploma or something.

• claimed Brooks showed no signs of aggression (he attacked police unprovoked, grappled with them, punched them, stole a weapon and shot it at them)
  
• claimed Brooks was cooperative and never showed himself as a threat (refer to above)
  
• claims the officers was never informed he was under arrest (he assaulted officers as soon as they started to say he was under arrested and cuff him, after they clearly said he was too drunk to drive)
  
• claims the officers failed to render timely medical aid when they were administering aid within 132 seconds of the shooting, as soon as they could secure the scene
  
• claims Brooks posed no threat because 2 shots of the 3 shot taser had already been used (as brooks shot that 3rd round at the cops, and as it was still usable in melee range, and as if cops can possibly expected to make such tactical calls in a split second)
  
• pressed the charges without consulting investigators at all, not even talking to the GBI let alone finding cause. The GBI was completely blindsided
  
• charged felony murder on the underlying crime of assault for the exact same action, both in violation of the felony murder rule and the merger doctrine that explicitly prohibits charging multiple elements of a crime separately
  
• claimed the other cop was a cooperating witness for the prosecution when he simply is not
  
• claimed a taser is not a deadly weapon and doesn't justify lethal force, just two weeks after prosecuting another case against cops where he claimed a taser is a deadly weapon and thus lethal force.

if they weren't yelling in the back of the class they could have grasped a concept of geometrical number analysis and wouldn't even need to know the equations to have a full feel of this important understanding
